Toll Violations - Sun Pass

Unknowingly receiving multiple toll violations can be a driver's worst nightmare. Today's technology allows for Florida's highways to be fitted with modern high speed toll plazas or high speed electronically monitored underpasses, containing cameras and toll capture devices which deduct tolls from transponders. While this technology has helped speed up commutes and has saved the state a lot of money, it has also created nightmares for many Florida driver's, visiting business people, and tourists.
If your transponder is not functional or if you unknowingly go through a toll monitored area, a picture is taken of your car's tag. Regardless of who was driving your vehicle, a traffic citation is generated, sent to the first listed owner's address, and recorded against that person's driver's license. This is true even if when you lend someone your car. If you moved or otherwise do not receive the citation and act upon it within 30 days, a driver's license suspension is generated. This could happen 50, 100, (or even 500) times in some cases we've handled, before you receives notice that your driver's license is suspended.
By that time, the citation is beyond the time period the courts allow to seek a hearing. Some court clerks advise the drivers that the only option is to pay each citation, plus late fees and reinstatements fees. Multiply the fines of $174.50 by the number of citations generated and add the late fees and reinstatement fees and you could be facing bills of $8,000 - $20,000.
To make the nightmare worse, say the driver actually pays several thousand dollars and clears the suspensions, each suspension carries 3 points. In Florida, the accumulation of 12 points (4 citations) within 12 months gets you a 30- day license suspension, 18 points within 18 months gets you a one year suspension. 15 moving violations will not only cause the revocation of your license for 5 years but you will be classified as a habitual traffic offender (HTO). If you are stopped driving thereafter, you will be charged with Felony Driving While License Suspended (DWLSR), a third-degree felony punishable by up to 5 years in state prison and you will need to post a bail bond of $5,000 to get out of jail.
Imagine if you were totally unaware that these citations exist or that this problem exists and get pulled over by a police officer. Lo and behold, you might find yourself on your way to jail. This will be the case until legislators realize the mess that this new law has caused and change things. In the meantime, there's the Ticket Law Center, P.A.
